Supreme Court Case

Protecting The Vets First Law

June 18, 2016. Veterans first in contracting as part of the Veterans Benefits, Health Care, and Information Technology Act of 2006 has been upheld by the Supreme Court. It has been a long ten years since its passage and a battle that the Department of Veteran’s Affairs predicted would be determined by the courts. The Supreme Court has reaffirmed what the General Accountability Office confirmed and what we have known to be true from the beginning. With this ruling, the Department of Veteran’s Affairs can continue its mission by setting aside opportunities for those who have served as it fulfills President Lincoln's promise: "To care for him who shall have borne the battle, and for his widow, and his orphan...” This ruling will directly impact the economic standing of thousands of certified service disabled and veteran owned companies and the millions they support.

We would like to thank Aldevra, Alternative Contracting Enterprises, LLC, Pierce First Medical Supplies and Government Logistics Solutions all of whom were fellow comrades engaged in some form of the battle along the way.

We would like to thank the late great Timothy Power, Esquire of Sonoma, California for being our legal pioneer in this effort. His work was much appreciated and we owe him a debt of gratitude. We would also like to thank our Supreme Court legal team at Wilmer Hale law firm. Their willingness to listen, superb acumen, vast legal intellect and tireless devotion to perfecting our arguments are all directly attributable to the Supreme Court’s comprehensive understanding of our position and the high court’s unanimous decision in our favor.

We would also like to thank the following law firms and supporters for filing Amicus briefs on our behalf: Winston Strawn, Duane Morris, Hogan Lovells, Sidley Austin, Koprince Law and Jenner & Block. We would like to thank our supporters and amici supporters including the American Legion, the National Veterans Legal Services Program, the National Veterans Small Business Coalition, the Task Force for Veterans’ Entrepreneurship (VET-FORCE), the National Association for Black Veterans, the National Veteran Business Development Coalition, the National Veteran-Owned Business Association, the Federal Circuit Bar Association, the Paralyzed Veterans Association, the Vietnam Veterans of America, the Military Officers Association of America, and the Iraq and Afghanistan Veterans of America. We would like to thank our veteran owned small business amici and supporters including Division Construction Inc, Spartan Medical Inc., Women Veterans Business Solutions, LLC, Crosstown Courier Service, Inc., Applied Fab and Machining, AeroSage LLC, BlackBox Migrations LLC, VanDahl Engineering & Sales, POTHOS, Inc., Shelby Distributions, Inc., VetlikeMe and Aldevra.

We would also like to thank the original legislators as well as the following Amici Congressional supporters including Rep. Gus Bilirakis (R-FL), Rep. Marsha Blackburn (R-TN), Sen. John Boozman (R-AR), Rep. Mike Bost (R-IL), Rep. Corrine Brown (D-FL), Rep. Steve Chabot (R-OH), Rep. Judy Chu (D-CA), Rep. Mike Coffman (R-CO), Rep. Ryan A. Costello (R-PA), Rep. Susan A. Cresent Hardy (R-NV), Rep. Mike Honda (D-CA), Rep. Will Hurd (R-TX), Rep. Bill Johnson (R-OH), Rep. Ann Kirkpatrick (D-AZ), Rep. Steve Knight (R-CA), Rep. Ann M. Kuster (D-NH), Rep. Doug Lamborn (R-CO), Rep. Brenda L. Lawrence (D-MI), Sen. John McCain (R-AZ), Rep. David McKinley (R-WV), Rep. Grace Meng (D-NY), Rep. Jeff Miller (R-FL), Sen. Jerry Moran (R-KS), Rep. Seth Moulton (D-MA), Rep. Pete Olson (R-TX), Rep. Aumua Amata Coleman Radewagen, Rep. Reid J. Ribble (R-WI), Rep. Phil Roe (R-TN), Rep. Steve Stivers (R-OH), Rep. Marlin A. Stutzman (R-IN), Rep. Mark Takai (D-HI), Sen. Jon Tester (D-MT), Rep. Nydia M. Velázquez (D-NY), and Rep. Jackie Walorski (R-IN).

We would also like to thank the founder of Quality Support, the owners of Aldevra and the president of the northern California chapter of the SDVOSB/DVBE Network, Inc. for their tireless advocacy for this and other veteran causes and their assistance in reaching the masses of veterans across the country.

Lastly, we want to thank all who have served and are serving.

We are extremely grateful!
